Survival of the Marginalized: Rohingya Muslims and the Need for a Saarc Refugee Framework

Forced migration and illegal trafficking of refugees has set off a critical human rights issue in our time, resulting in increasing international legal and political concern that deserves but has not yet adequately received enough scholarly attention. One of such forgotten but deserving issues is the extreme violation of human rights in Burma, with Rohingya muslims. Until recently, thousands of Rohingya Muslims have been killed, in what has been described as “ethnic cleansing”, and it continues to be a “blind spot” for the world in common, and the subcontinent in specific. Even the UN accepts that the “Rohingya are the world’s most ignored and persecuted community.” It won’t be implausible to suggest that, this consistent racist attitude of the state government towards the Rohingya Muslims is aimed at extermination or exodus of the community. As a consequence, most of the Rohingya Muslims try migrating to the neighbouring state of Bangladesh. Notably, facing chronic refugee crisis, Bangladesh has at many instances forcibly deported the Rohingyas by using excessive force. Through this paper, the authors point out the failure of the international law and its enforcing institutions in addressing these “crimes against humanity” and the West’s selective attitude in dealing with Human Rights abuses. The paper seeks to establish the need for a SAARC refugee framework, for dealing with such situations, so that the burden does not fall on some nations alone. We examine the existing regulatory framework dealing with asylum seekers entering the country undocumented and provide recommendations, on the lines of Refugee Convention, 1951 and other international obligations. Testimony of child: Position in India

Testimony of a witness is treated as crucial evidence in court proceedings which leads the court to decide the listed matter. But there are some criteria for a witness which is to be fulfilled before giving its testimony (like sane mind etc.) Historically, we have witnessed that admissibility of a child’s testimony was not absolute in nature. Under section 118 of Indian Evidence Act, it says that every person is competent to witness unless it is restricted by the court from the questions put to him or from giving reasonable reasons because of instrumentality of age. This article deals with the child giving the testimony and whether that testimony is acceptable or not. The court has to testify the child’s statement by putting some additional questions to him also corroborating its statement. Mind of a child is very sensitive and also they are tender in nature therefore there mind can be easily modulated. This article also deals question of admissibility, testimony of child, competence of the testimony, Principle of “Voir dire test” and need for corroboration. Keywords: Testimony of child

Interrelation between Criminal Behavior and Psychology

Criminology is a branch that deals with different set of information like crime, criminals and their punishments. Many questions have been raised what are the factors that initiate the person to commit the crime or unlawful activities. For finding the answer of this question, the psychologists worked and suggested that the psychology or thoughts the person are responsible for the commission of crime. Although the environmental factors are also contribute in the criminal activities. This paper discussed about the crime, criminals and their psychology that affects their actions. The paper majorly concerns on the factor that inferences both the criminal behavior and its related psychological theories. The chief concern is to discuss about the mental stability connecting the health problems and the behavior of criminals that will alter the mental thinking of a person with respect to the connection towards criminal activity. The paper basically review on the different working and collection of the information conducted on the basis of relationship between psychology and criminal behavior as well a show how psychology is interlinked with the criminal behaviors. It also covers the different emotion aspects which once created the psychological imbalance and pushed person’s psychology towards criminal act i.e. both the purpose of protection and revenge.
